These are the terms and conditions which apply to the use of the Motion Flicks services:

Content

• Content on the Motion Flicks site has been rated as adult entertainment for mature audiences only (over 18 years of age). Viewer discretion is advised.
• Motion Flicks shall have the right at any time to change or modify this service including content, prices, security features, billing methods.
• Motion Flicks is not responsible for the accuracy of third party information provided and posted in the Motion Flicks catalogue.
• All comments, ratings, rankings, reviews and statements on Motion Flicks surveys and discussion forums are the sole opinion of the person making them and not that of Motion Flicks .
• All opinions, scenarios, stories or depictions that appear in any film on MotionFlicks.com are that of the filmmaker, and are not to be construed, interpreted or implied to be that of MotionFlicks.com; it's owners, operators or employees.

Billing

A record of your order will be maintained in the Motion Flicks billing system for a certain time period. You can check with our billing department regarding any order made at billing@motionflicks.com.

• Motion Flicks will store all of your personal billing information in a secure database which can only be accessed by authorized personnel. None of your information will be sold to marketing or sales firms, and is accessed solely for the purposes of providing the service.

Liability

• Purchases made by you on this service shall only be made with a valid credit card for which you have been authorized to incur charges. You will not impersonate someone else, or use a credit card, charge card, bank card, prepaid or subscription account, or email address belonging to someone else to transact with Motion Flicks without written permission, proof of which shall be supplied by you in the event of any dispute.
• Motion Flicks is not liable for any damages to your computer or home entertainment system as a result of either downloading a film file, or inserting a DVD into your equipment for viewing.

Refund Policy

• Motion Flicks will not pay damages for any delays, flaws, or errors in the transmission or final delivery of the film file. If a file is not received, the system is designed to detect the error and instruct you to download it again. Problems with the download process or any delay in the delivery of a DVD through the mail should be addressed to support@motionflicks.com.
• Motion Flicks attempts to be as accurate as possible. However, Motion Flicks does not warrant that product descriptions or other content of the MotionFlicks.com site are accurate, complete, reliable, current, or error-free. If a product offered by Motion Flicks is not as described, your sole remedy is to return it in unused condition.
• Motion Flicks will immediately investigate any billing, lost goods, quality or performance complaints received and either resolve the problem or give you a full refund, within a reasonable time frame from receipt of the complaint.

Dispute Procedure

• If you are not satisfied with anything about our service please report your concerns to support@MotionFlicks.com. We will provide an initial response within 48 hours and we promise to do our best to resolve the complaint within seven (7) days.
• If you are not satisfied with our initial response, or our attempt at a resolution, then all non-monetary complaints will be escalated to our senior management team for resolution. All valid product complaints will result in a full refund.
